It is a part of the natural instincts of humankind and the basis of all social institutions. The main aim of this study is to analyze legal aspects of Freedom of Expression in Nepal from media perspectives, in the spirit of global and Constitutional features of the public communication system. For conducting this research, both qualitative and quantitative methods of data collection, such as questionnaire surveys, focus group discussions, key informant interviews and case study methods have been employed. The study has found that the government of Nepal has equipped the people by disseminating the policy related decision and other necessary information. In course of the study, the researcher got to know that majority of the respondents believe that the Constitution of Nepal and other laws are playing crucial roles in protecting the press freedom and freedom of expression. The study has concluded that a higher awareness level is better for good governance. Freedom of Expression is essential but needs to be limited to the extent that countrywide security, public order, and social-ethnic harmony have not compromised. Moreover, Nepal's media play an important role in flourishing Freedom of Expression. Respondents have been found very optimistic about the future of Freedom of Expression in Nepal. In Nepal, the Government has persistently attempted to restrict the basic right to Freedom of Expression. It is imperative to ensure the right to freedom of expression in order to uphold the separation of powers and the rule of law. The Constitution of Nepal ensures the ideal rights of citizens, such as Freedom of Expression. All rights are tied to press freedom because the press is a section of society. The majority of respondents are aware of the Freedom of Speech and Opinion. The Constitution of Nepal has ensured the indispensable rights of citizens, as the freedom of expression which is said to be integral part to upholding the separation of power, check and balance, limited Government, transparency, human rights, good and accountable governance, Constitutionalism and the rule of law. Though the Constitution of Nepal guarantees the integral rights of citizens that is the Freedom of Expression as mentioned earlier, it has been found numerous lacunas in its exercises. The reason behind is that the Executive and Media seem to have poor performance in their roles whereas the role of the Judiciary seem to be more balanced. Both the Executive and the Media are created for the people's services, but they seem to be lagging behind in playing their proper roles that they are assigned to. According to the Social Responsibility Theory, they should be accountable to the people and the society but in reality, it is not so.
