Item Compliance of devolution in local bodies (A study of Parsa District, Nepal)(Department of Public Administration, 2017) Bhusal, Tara PrasadThis Thesis entitled „Compliance of devolution in Local Bodies‟ is conducted in Parsa District of Nepal.The main objective of this study is to explore the compliance of devolution in local bodies in actual practice as mentioned in LSGAACT 1999. Decentralization follows transfer of power and responsibility from center to region, sub-national and local levels. Local self-governance is the means of autonomy through decentralization. Principle of subsidiarity is the fundamental philosophy of it. Since 1960s, Nepal is practicing decentralization in different ways up to now. This is made due to gap between theory and practice. Whatever we have different legal and policy structure to apply the decentralization, the application of it among different form like devolution is also not practiced in real field as mentioned in LSGA ACT 1999. So, researcher has triedto explore the basic cause about it. This study is based on the primary and secondary sources of information. Information was collected through qualitative tools. The questionnaire was used and check list (Focus Group Discussion) was used as a qualitative tool. Seven samples were taken randomly as sample size and the respondents were DDC officials, NGOs, INGOs, CBOs representatives and parliament members. This study has been prepared in 5 different chapters. This study has focused on the hypothesis testing in the variable of political initiation, bureaucratic commitment, monitoring institution, financial resource availability and creating local environment. The result of the study shows except financial resource availability and creating local environment, other variables reflect the result that more than 70 percent compliance of devolution in local bodies even though not hundred percent. Due to various factors, the application of devolution is affected in real field. The financial resource availability variablehas been shown more than sixty percent resource scarcity. This does not show compliance as we expected in policy. Local environment is also hampering in local level activities day to day. The result of this variable shows fifty percent non-compliance in field level during research findings. So, it can be concluded that due to political weakwillingness to devolve the power, low proactive commitment of bureaucrat, weak and ineffective monitoring system, scar of financial resources as need in local demand and less supporting local environment for policy implementation are the major reasons not to fully compliance of devolution as in policy. To promote the enjoyment of the fruits of democracy by maximizing the participation of the sovereign people in the process of governance by way of decentralization and devolution of services from the centre to the local level there are provisioned two tire local bodies District development committee and Village development committee/Municipality. Every year government provides the grant to VDC for carrying out development activities. This study gives attention the status of utilization of block grant by local bodies in Nepal. To find out the status of grant received by VDC from national budget and District Development Committee, status of women, children and disadvantage people participation in planning, implementation and decision making process of VDCs and what are the challenge and constraint to implement the budget and program is three major objective of this study. This study carried out based on explorative and descriptive both type of research design. The nature and source of date collection through primary as well as secondary method. Main source of primary data are collect form Padampur VDC.For the primary data collection choosing seventy two respondents throughout the VDC through accidental method. Observation method also applied for the data collection. Other secondary data collect from different published, book, journal which is published by respective VDC and DDC and different website as well.Likewise,an interview was conducted to each key informant with structured or unstructured questionnaire. Similarly, data collection form general public and focus group discussion with structured and prepared open ended question. This study was carried out three major objectives. The first objective was to find out the status of grant received by VDC from national budget and DDC. As per the finding of this study, VDC have got regularly grant from national budget as target.But,a very few budget got VDC from DDC compare to target and there is no reliability to got budget from DDC. Second objective was to find out the status of women, children and disadvantage people participation in planning, implementation and decision making process in VDCs. The number of participation from target group is rising way since commencement of LSGA. However, there is lack of meaningful participation. So,need to meaningful participation of target group. There is number of challenge and constriction to implement the budget and program of VDCs. Absent of elected local bodies, very few number of staffs in VDCs, raising work load, lack of proper knowledge regarding the job responsibility, unhealthy competition, lack of coordination are major challenge and constraint to implement the budget and program. For the effective implementation of decentralization policy GoN has bring in various Act, Regulation and Guidelines. Government has had prepare separate guideline for effective implementation and proper utilization of VDC grant and earmarked certain percent budget for children, women and disadvantage people.Despite the fact the compliance of budget allocation and program implementation system still out of track. It is hoped that this study will help to understand how VDC allocate VDC grant and made expenditure. Absent of elected local bodies, raising work load of staffs, lack of proper knowledge for the job responsibility, political interferes, lack of coordination are VII major challenges and constraints to implement the budget and program. Government has prepared separate guideline for effective implementation and proper utilization of VDC grant and earmarked certain percent budget for children, women and disadvantage people. The findings of the study is d evelopment activities are approved on the basis of community demand but the prioritization is made on the basis of the available fund and to some extend interest of the political party and pressure group as well. Though participation of women, children and disadvantage group has been in the priority list of local governments but they have not been able to receive the benefits as expected. However, the result of this VDC looks much better in terms of participation and benefits sharing by the target groups. People’s participation are not encourage by the local government and the budget allocated for the target group are used as per their desire as they could not identify the focus program for the target groups. Project are mostly selected on the basis of the personal interest . The function, duty and power of local bodies is to look after agriculture, rural drinking water, works and transport, education and sports, irrigation and soil erosion and river control, physical development, health service, forest and environment, language and culture, tourism and cottage industries development etc. The function, duty and power of council are to pass the budgets, plans and program submitted through participatory planning process. Despite the fact of the compliance of budget allocation and program implementation systems are still out of track. It is hoped that this study will help to understand how VDC allocate VDC grant and made expenditure. Similarly, this study will help to find the level of women, children and disadvantage people participation in VDC level. The large contribution that these grants make to local development has led the Government to increase the amount over recent years.
